Partner Terms

By signing up as a brand partner, or by accessing the brand dashboard, you agree to these Terms on behalf of the brand you represent. You confirm that you have the authority to accept these Terms on that brand's behalf.

You can sign up directly, or through your Shopify store. There's no application to review: after you sign up, we'll arrange a call with you to set up your brand dashboard for your tier. You agree to give us accurate information about your brand and to keep it up to date.

Growth currently offers three tiers: Visibility, Intelligence, and Co-Creation, described on our for founders page. Growth is under active development: the features available in your tier, and the dashboard itself, may change as we build. We'll tell you about material changes that affect your partnership.

Once you've signed up, you'll get access to a brand dashboard where you can manage your brand's settings, connect your Shopify store, and view insights as they become available. You're responsible for keeping your account credentials confidential and for the accuracy of the information you enter, including your Shopify store connection.

You keep ownership of the business information you give us: your brand details, revenue figures, product information, and similar data. By providing it, you grant enless a license to use it to set up and operate your partnership, and generate the insights and analytics described in your tier. We don't sell your business data or share it with other brands.

Some Growth features, like Shopify-connected insights, may involve enless processing personal data about your own customers on your behalf. Where that happens, enless acts as your data processor and you remain the data controller for that data. Before any such processing goes live with real customer data, we'll enter into a separate Data Processing Agreement with you under Art. 28 GDPR, covering the scope, security measures, and sub-processors involved.

Each party agrees to keep the other's confidential information, including business data, analytics, methodology, and the terms of your partnership, confidential, and to use it only to operate the Growth partnership. This doesn't apply to information that becomes public other than through a breach of these Terms, or that either party already lawfully knew.

Growth doesn't currently charge any fees during this early-access phase. If we introduce pricing for any tier, we'll share the commercial terms: price, billing frequency, and cancellation terms, with you in writing before anything is charged, and you'll need to agree to them separately.

enless owns the Growth platform, dashboard, and the methodology behind our analytics and insights. You own your own brand assets, trademarks, and the data you provide. Where we generate insights or reports specifically for your brand from your data, you may use them for your own business purposes; we don't claim ownership over your underlying business data by processing it.

Your partnership continues until either party ends it. You can request account closure at any time by contacting us. We may suspend or end a partnership if you breach these Terms, misuse the dashboard, or if we discontinue Growth, and we'll give you notice where practical.

Growth, including any analytics or insights it provides, is offered "as is" and without warranty of accuracy or fitness for a particular business purpose. To the maximum extent permitted by law, enless isn't liable for indirect, incidental, or consequential damages arising from your use of Growth. Nothing here limits liability that can't be limited under applicable law.

These Terms are governed by Austrian law, without regard to its conflict-of-law principles. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

We may update these Terms as Growth develops or for legal, operational, or regulatory reasons. We'll update the "Last updated" date above, and if changes materially affect your partnership, we'll tell you before they take effect.
